Pit Pony Terms of Service

1. Using Pit Pony

Pit Pony is intended to assist users with organization, scheduling, reminders, forms, notes, PPE tracking, and access to informational safety resources.

You agree to use Pit Pony lawfully, responsibly, and in accordance with your employer's policies, applicable laws, and workplace requirements.

Pit Pony is intended to support users. It is not intended to replace training, supervision, emergency services, or personal judgment.

2. Eligibility

You must be legally permitted to enter into agreements under the laws applicable to you.

If you are using Pit Pony on behalf of an employer or organization, you represent that you have authority to do so.

3. Subscriptions and Purchases

Certain Pit Pony features may require a paid subscription.

Subscriptions are processed through Apple, Google, or other supported marketplaces.

Pricing, billing cycles, cancellations, refunds, and renewals are controlled by the applicable app marketplace.

Pit Pony Universe does not collect or store payment card information.

Features offered under subscriptions may change over time.

Safety references and emergency informational resources are intended to remain freely available whenever reasonably possible.

4. Downloads and Additional Content

Pit Pony may provide access to downloadable materials including:

• Themes
• Form templates
• Icons
• Images
• Static assets
• Configuration files
• Manifest files

Downloads are intended only to enhance or personalize the Pit Pony experience.

Downloads do not modify application code.

Downloads do not install software.

Downloads do not grant access to hidden features.

Pit Pony Universe may update, remove, or discontinue downloadable content at any time.

5. Enterprise Materials

Pit Pony may support company-specific materials in the future.

Organizations cannot directly upload content for distribution to users.

Materials intended for enterprise distribution must be submitted directly to Pit Pony Universe for review and manual inclusion.

Pit Pony Universe reserves the right to decline, edit, delay, or remove submitted materials.

6. User Information

Pit Pony does not require user accounts.

Pit Pony does not provide social networking.

Pit Pony does not provide public profiles.

Pit Pony does not provide user-to-user messaging.

Pit Pony does not provide public content sharing.

Information entered into Pit Pony is generally stored locally on the user's device.

Users remain responsible for backing up important information.

7. Forms and Exported Documents

Pit Pony may allow users to create forms, attach information, export PDF files, or share generated documents.

Users are responsible for reviewing exported documents before relying upon, distributing, or submitting them.

Pit Pony Universe is not responsible for:

• Incomplete forms;
• Lost files;
• Submission failures;
• Incorrect information entered by users;
• Employer rejection of generated forms.

Users remain responsible for ensuring forms meet workplace expectations.

8. Acceptable Use

Users agree not to:

• Attempt to reverse engineer Pit Pony;
• Circumvent subscriptions;
• Interfere with app operation;
• Inject code;
• Distribute unauthorized modifications;
• Misrepresent Pit Pony as an employer system, government service, or emergency response platform;
• Use Pit Pony in violation of applicable law.

9. Safety Materials

Pit Pony contains informational safety content.

Safety content is provided to assist users but may not reflect the most current standards, regulations, employer procedures, or local requirements.

Users should always follow official guidance provided by employers, emergency responders, regulators, and qualified professionals.

Pit Pony Universe does not guarantee completeness or suitability of informational content.

10. Availability

Pit Pony Universe attempts to maintain availability of services, downloadable content, and website resources.

However, Pit Pony may occasionally be unavailable due to:

• Maintenance;
• Operating system changes;
• Service interruptions;
• Hosting changes;
• Technical issues;
• Factors outside our control.

Availability is not guaranteed.

11. Intellectual Property

Pit Pony, Pit Pony Universe, characters, artwork, themes, logos, motion comics, stories, icons, downloadable resources, and related materials remain the property of Pit Pony Universe or its licensors.

Users may enjoy, use, and personalize materials as intended within Pit Pony.

Commercial reproduction, redistribution, or resale is prohibited without permission.

Non-commercial fan creations are generally welcomed, provided they do not misrepresent affiliation or ownership.

12. Changes to These Terms

Pit Pony Universe may update these Terms periodically.

Continued use of Pit Pony after updates become effective constitutes acceptance of the revised Terms.

13. Termination

Pit Pony Universe reserves the right to suspend or terminate access to downloadable resources or services if these Terms are violated.

Users may discontinue use of Pit Pony at any time by uninstalling the application.

14. Limitation of Liability

To the fullest extent permitted by law, Pit Pony Universe shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from use of Pit Pony.

This includes, but is not limited to:

• Missed alarms;
• Lost schedules;
• Missed shifts;
• Incomplete forms;
• Lost information;
• Device failures;
• Service interruptions;
• Reliance upon informational content.
