Pit Pony End User License Agreement

1. What Pit Pony Is

Pit Pony is a mining schedule, alarm, forms, reminders, PPE, notes, and safety reference app built by a miner for shift workers.

Pit Pony is intended to help users organize work-related information and access helpful reference materials. It does not replace employer procedures, site-specific rules, regulatory requirements, professional judgment, emergency services, or formal safety training.

2. License

Pit Pony is licensed, not sold.

We grant you a limited, non-exclusive, non-transferable, revocable license to use Pit Pony on devices you own or control, subject to this Agreement and the rules of the app store where you downloaded it.

You may not copy, modify, reverse engineer, distribute, sell, rent, sublicense, or attempt to extract the source code of Pit Pony except where allowed by law.

3. App Store Terms

If you downloaded Pit Pony from the Apple App Store, this Agreement is between you and Pit Pony Universe, not Apple. Apple is not responsible for Pit Pony or its content.

Apple and Apple’s subsidiaries are third-party beneficiaries of this Agreement and may enforce this Agreement as it relates to Apple platform requirements.

If you downloaded Pit Pony from Google Play, your use of Pit Pony may also be subject to Google Play terms and policies.

4. Subscriptions and Paid Features

Some Pit Pony features may require a paid subscription or purchase.

Billing, renewals, cancellations, refunds, and payment processing are handled by the app store where you made the purchase.

Pit Pony Universe does not directly receive or store your payment card information.

Free features may change over time. Safety and emergency reference materials are intended to remain available without charge whenever reasonably possible.

5. Safety and Emergency Information

Pit Pony may include safety references, emergency information, checklists, reminders, or related materials.

These materials are informational only.

Pit Pony is not a substitute for:

• Employer safety training;
• Site-specific procedures;
• Government regulations;
• Mine rescue procedures;
• Professional medical advice;
• Emergency services;
• Your own judgment.

Always follow your employer’s rules, applicable laws, posted procedures, and instructions from qualified personnel.

In an emergency, contact emergency services or site emergency response according to your location and workplace procedures.

6. SOS and Emergency Contact Features

Pit Pony may include tools intended to help send location or emergency information to contacts you choose.

These tools depend on your device, permissions, operating system, network connection, location services, cellular service, messaging availability, and third-party providers.

Pit Pony Universe cannot guarantee that any SOS message, location, notification, alarm, or emergency communication will be sent, received, accurate, timely, or acted upon.

You are responsible for confirming that your emergency contacts, device settings, and workplace emergency procedures are appropriate for your situation.

7. Alarms, Notifications, and Reminders

Pit Pony may use device alarms, reminders, and notifications.

Alarm and notification delivery can be affected by device settings, operating system behavior, battery optimization, focus modes, notification permissions, manufacturer restrictions, software updates, and other conditions outside our control.

Do not rely on Pit Pony as your only method for waking up, attending work, responding to emergencies, or meeting time-sensitive obligations.

8. User Data and Local Storage

Pit Pony does not require a user account.

Pit Pony does not require you to log in to a website.

Pit Pony does not operate a server account system for storing your schedules, notes, reminders, forms, PPE records, or similar app content.

Information you enter into Pit Pony is intended to be stored locally on your device unless a feature clearly tells you otherwise.

You are responsible for your own device, backups, exported files, shared PDFs, and information you choose to send outside the app.

Deleting the app, clearing app data, changing devices, or losing access to your device may result in loss of locally stored information.

9. No User-Generated Public Content

Pit Pony does not provide public posting, social networking, user profiles, public feeds, comments, chat rooms, or user-to-user content sharing.

Users and organizations cannot directly upload content into Pit Pony for distribution to other users.

If enterprise or organization-specific forms, themes, or resources are supported in the future, those files must be provided to Pit Pony Universe and manually reviewed or added by Pit Pony Universe before being made available.

10. Downloads and External Content

Pit Pony may allow downloading of static content such as themes, images, form templates, icons, manifests, or other resources.

Downloads are content only.

Downloads do not change Pit Pony’s application code.

Downloads do not install executable code, scripts, plugins, or outside software into Pit Pony.

We may add, remove, update, or change downloadable content at any time.

11. Forms, PDFs, and Shared Files

Pit Pony may allow users to create forms, attach information, export PDFs, or share files.

You are responsible for reviewing any information before using, submitting, sending, or relying on it.

Pit Pony Universe is not responsible for incomplete, inaccurate, lost, misdirected, or improperly submitted forms or files.

Your employer or organization may have its own rules for forms, inspections, reports, records, and document retention.

12. Ownership and Intellectual Property

Pit Pony, Pit Pony Universe, related names, logos, characters, artwork, software, designs, themes, icons, and other materials are owned by Pit Pony Universe or its licensors.

You may use Pit Pony only as allowed by this Agreement.

You may not use Pit Pony Universe artwork, characters, branding, or downloadable content for commercial purposes without written permission.

13. Acceptable Use

You agree not to:

• Use Pit Pony for unlawful purposes;
• Attempt to bypass subscriptions or access controls;
• Interfere with app operation;
• Upload, distribute, or attempt to inject unauthorized content or code;
• Misrepresent Pit Pony as an official employer, regulatory, emergency, or government system;
• Use Pit Pony in a way that could harm others.

14. Updates and Changes

Pit Pony may be updated to improve features, fix bugs, change content, or maintain compatibility with operating systems.

Some features may be added, changed, limited, or removed over time.

Your continued use of Pit Pony after updates means you accept the updated version of the app and this Agreement.

We will try to help when reasonably possible, but we do not guarantee response times or availability of support.

16. Disclaimer of Warranties

Pit Pony is provided “as is” and “as available.”

To the fullest extent permitted by law, Pit Pony Universe disclaims warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, and non-infringement.

17. Limitation of Liability

To the fullest extent permitted by law, Pit Pony Universe will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, missed work, missed alarms, failed communications, injury, operational losses, or reliance on safety information.

Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.

18. Product Claims

Pit Pony Universe, not Apple or Google, is responsible for addressing claims relating to Pit Pony, including product liability claims, legal compliance claims, consumer protection claims, or intellectual property claims, to the extent required by applicable law.

19. Termination

This Agreement remains in effect until terminated by you or Pit Pony Universe.

You may terminate it by deleting Pit Pony and stopping use of the app.

We may terminate this Agreement if you violate it.

Upon termination, you must stop using Pit Pony.

20. Governing Law

This Agreement will be governed by the laws applicable in your place of residence unless another governing law is required by applicable app store rules or local law.
