Pit Pony Adventures End User License Agreement

1. What Pit Pony Adventures Is

Pit Pony Adventures is a free app created to encourage curiosity, stories, learning, creativity, family time, and safe exploration.

Pit Pony Adventures may include stories, motion comics, character cards, activities, coloring-style features, learning materials, downloadable story packs, and other curated content.

Pit Pony Adventures is intended for families, children, parents, guardians, and curious people of all ages.

2. License

Pit Pony Adventures is licensed, not sold.

We grant you a limited, non-exclusive, non-transferable, revocable license to use Pit Pony Adventures on devices you own or control, subject to this Agreement and the rules of the app store where you downloaded it.

You may not copy, modify, reverse engineer, distribute, sell, rent, sublicense, or attempt to extract the source code of Pit Pony Adventures except where allowed by law.

3. App Store Terms

If you downloaded Pit Pony Adventures from the Apple App Store, this Agreement is between you and Pit Pony Universe, not Apple.

Apple is not responsible for Pit Pony Adventures or its content.

Apple and Apple’s subsidiaries are third-party beneficiaries of this Agreement and may enforce this Agreement as it relates to Apple platform requirements.

If you downloaded Pit Pony Adventures from Google Play, your use of Pit Pony Adventures may also be subject to Google Play terms and policies.

4. Free App

Pit Pony Adventures is intended to be free.

Pit Pony Adventures is not intended to include paid subscriptions, in-app purchases, or advertising.

If this changes in the future, the applicable legal documents and store disclosures will be updated before such features are offered.

5. Parent and Guardian Responsibility

Pit Pony Adventures may include activities, stories, experiments, printable-style ideas, outdoor exploration prompts, or learning suggestions.

Parents and guardians are responsible for determining whether activities are appropriate for their child, age, location, abilities, and circumstances.

Activities should be supervised when appropriate.

Pit Pony Universe is not responsible for injuries, property damage, allergic reactions, misuse of materials, unsafe locations, weather conditions, or failure to follow reasonable safety precautions.

6. Educational and Activity Content

Pit Pony Adventures may include educational information, science ideas, nature observations, safety reminders, and activity suggestions.

This content is informational and recreational.

It is not professional instruction, medical advice, emergency guidance, legal advice, or a substitute for adult supervision.

Users should not eat unknown plants, mushrooms, rocks, insects, slime ingredients, or other materials found during activities.

7. No Social Networking or Public Uploads

Pit Pony Adventures does not provide:

• Public profiles
• Public posting
• Social feeds
• User-to-user messaging
• Chat rooms
• Public comments
• Direct user uploads for publication
• User-generated content distribution

Users may suggest adventure ideas, theme ideas, or story inspiration to Pit Pony Universe through approved contact methods.

Suggestions are not automatically published, uploaded, shared, or added to the app.

All content made available through Pit Pony Adventures is curated, reviewed, selected, or added by Pit Pony Universe.

8. Downloads and Story Packs

Pit Pony Adventures may allow downloading of static content such as:

• Story packs
• Images
• Audio
• Character cards
• Coloring pages
• Activity files
• Manifests
• Other curated resources

Downloads are content only.

Downloads do not modify application code.

Downloads do not install executable code, scripts, plugins, or outside software into Pit Pony Adventures.

Pit Pony Universe may add, remove, update, or change downloadable content at any time.

9. Camera, Gallery, and Local Features

Pit Pony Adventures may include local features such as an in-app camera, private gallery, coloring tools, activity tools, timers, or checklists.

Unless a feature clearly states otherwise, information created inside the app is intended to remain on the user’s device.

Users and parents are responsible for managing, deleting, exporting, or backing up locally stored content.

10. Intellectual Property

Pit Pony Adventures, Pit Pony Universe, related names, logos, characters, artwork, stories, cards, motion comics, icons, music, audio, activities, designs, and other materials are owned by Pit Pony Universe or its licensors.

You may use Pit Pony Adventures only as allowed by this Agreement.

You may not use Pit Pony Universe artwork, characters, branding, or downloadable content for commercial purposes without written permission.

11. Fan Creations, Printable Materials, and Suggestions

Pit Pony Universe welcomes creativity.

Users may create non-commercial fan art, drawings, crafts, costumes, stories, educational activities, and similar creations inspired by Pit Pony Universe.

Printable activities, coloring pages, story packs, educational materials, and similar resources provided by Pit Pony Universe may be downloaded, printed, copied, and shared for personal, family, classroom, library, scouting, club, homeschool, and other non-commercial educational purposes.

Examples of permitted uses include:

• Parents printing activities for children;
• Teachers printing activities for students;
• Libraries using activities during programs;
• Scout leaders using materials with their groups;
• Homeschool families using materials for lessons or activities;
• Community groups using resources for non-commercial educational events.

Users may not:

• Sell Pit Pony Universe materials;
• Repackage Pit Pony Universe materials as their own work;
• Remove copyright notices or attribution where present;
• Include Pit Pony Universe materials in products, services, bundles, downloads, or events offered for sale without written permission;
• Use Pit Pony Universe characters, artwork, names, logos, or materials in adult, hateful, harassing, unsafe, misleading, or unlawful content.

Fan creations must not imply they are official, endorsed, or affiliated with Pit Pony Universe unless written permission is given.

Suggestions, ideas, drawings, themes, adventure inspiration, and other submissions are appreciated, but submitting them does not guarantee they will be used, added, published, credited, acknowledged, or returned.

Pit Pony Universe may decline submissions that are inappropriate, unsafe, unlawful, misleading, adult-oriented, hateful, harassing, commercial, or inconsistent with the tone and values of the project.

12. Acceptable Use

You agree not to:

• Reverse engineer the app;
• Attempt unauthorized access;
• Distribute modified versions;
• Use Pit Pony Adventures unlawfully;
• Attempt to inject unauthorized content or code;
• Misrepresent unofficial content as official;
• Use Pit Pony Adventures in a way that could harm children, families, users, or Pit Pony Universe.

13. Updates and Changes

Pit Pony Adventures may be updated to improve features, fix bugs, change content, or maintain compatibility with operating systems.

Some features may be added, changed, limited, or removed over time.

Your continued use of Pit Pony Adventures after updates means you accept the updated version of the app and this Agreement.

We will try to help when reasonably possible, but we do not guarantee response times or availability of support.

15. Disclaimer of Warranties

Pit Pony Adventures is provided “as is” and “as available.”

To the fullest extent permitted by law, Pit Pony Universe disclaims warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, and non-infringement.

16. Limitation of Liability

To the fullest extent permitted by law, Pit Pony Universe will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of Pit Pony Adventures.

This includes, but is not limited to, injuries, property damage, lost data, unavailable downloads, misunderstood activity instructions, device issues, or reliance on educational or activity content.

17. Product Claims

Pit Pony Universe, not Apple or Google, is responsible for addressing claims relating to Pit Pony Adventures, including product liability claims, legal compliance claims, consumer protection claims, or intellectual property claims, to the extent required by applicable law.

18. Termination

This Agreement remains in effect until terminated by you or Pit Pony Universe.

You may terminate it by deleting Pit Pony Adventures and stopping use of the app.

We may terminate this Agreement if you violate it.

Upon termination, you must stop using Pit Pony Adventures.

19. Governing Law

This Agreement will be governed by the laws applicable in your place of residence unless another governing law is required by applicable app store rules or local law.
